Transfer of a Kentucky Titled Vehicle
Currently, there are several types of Kentucky Titles that have been issued to vehicles. Titles issued after February 2000 have the assignment portion and Vehicle Transaction Record (VTR) form combined on the back of the Certificate of Title. These titles would not require the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) in order to transfer a vehicle. Titles issued prior to February 2000 only have the assignment portion on the back of the Certificate of Title and would require the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) in order to transfer a vehicle. Any Kentucky resident who has delinquent motor vehicle ad valorem property tax due cannot transfer a vehicle until those taxes are paid in full.

Kentucky Certificate of Title clear of all liens, with assignment portion properly completed by buyer and seller. The year your title was issued determines the procedure that you will follow.
- If your title was issued before February 2000, the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) must be completed. Form must be signed by all sellers and buyers and their signatures’ notarized. Persons that have power of attorney for the seller or buyer/owner(s) may sign, but a copy of the power of attorney must be submitted with the application. A power of attorney cannot sign for the seller and buyer if the vehicle is less than ten years old. If the County Clerk’s staff notarizes signatures, identification must be presented. Note-Titles that contain AND (instead of OR) or do not have a designation between names of owners require the signatures of all owners. Titles that contain OR or AND/OR only require the signature of one owner.
- Buyer must have Commonwealth of Kentucky proof of insurance to complete transfer. All insurance cards must have the insurance company’s five-digit NAIC number listed on the card. The effective date on the insurance card cannot be more than 45 days prior to the date of completing the transaction in our office.Insurance is not required for Title Only Transfers, but license plate must be surrendered. - Social Security Number for each party appearing on the title or Federal ID Number for companies.
- Special license plates, which are any plate that is not Unbridled Spirit or plain motorcycle plate, issued to the vehicle being transferred must be turned into the county clerk’s office at the time of transfer. A seller wishing to keep any special license plate needs to contact the county clerk’s office for assistance.
- If a loan was needed for the purchase of the vehicle, the buyer needs to indicate this on the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) or the Lien Portion on the back of Kentucky titles that were issued after February 2000. A pending lien will be noted and the buyer will be given a goldenrod copy of the registration to present to the lending institution. If the lending institution is located in another state the county clerk’s office will record the lien. Otherwise, the lending institution will use the goldenrod copy and Title Lien Statement-Form # TC96-187E to record the lien.
- All liens must be satisfied before transferring a vehicle. Termination statement Title Lien Statement-Form # TC96-187E must be completed by the financial institution and signed, then submitted to the clerk.
- Bullitt County Clerk’s Office accepts Cash, Personal Check, Money Order or Certified Check. The office does accept Visa, MasterCard and Debit. However, to process using a Credit/Debit Card, an additional processing fee is charged. Contact county clerk’s office for details. Credit/Debit Cards cannot be used over the phone.
Property Tax-If at the time of transfer, property tax has not been paid, the seller will be responsible for the tax. See Property Tax for further details. If the taxes have not been paid and they are delinquent, the taxes must be paid by the buyer or the seller at the time of transfer.

Usage Tax Fee (See Below): 6% of sale price, NADA or 50% Floor-Some Exemptions
NOTE-To file a lien the amount is $22.00, however, if the debtor does not file the lien within 20 days of its application, a penalty of $2.00 is assessed by the County Clerk. All liens not filed within 20 days will be $24.00.
Usage Tax-A six percent (6%) motor vehicle usage tax is levied upon the “retail price” of vehicles transferred in Kentucky. “Retail Price” could be 6% of the current average retail listed in the NADA Used Car Guide, 6% of the sale price or 90% Formula of the Manufacturer’s Suggested Retail Price (MSRP) for new vehicles. A new law passed January 1st, 2007 known as 50% Floor will require the buyer to pay no less than 50% of the trade-in value on any vehicle purchased (excluding vehicles 20 years or older, motorcycles, recreational vehicles and vehicles branded rebuilt). Kentucky Title Transfer Due to Death
The death of a family member can be a very difficult time. The clerk’s office would like to help make the transfer of vehicles, boats and trailers as easy as possible. The Commonwealth of Kentucky requires certain documentation to transfer vehicles from the name of a deceased person. Most residents believe that a Will of Testament is the only paperwork needed for the transfer. However, this information is incorrect. The following information will discuss the documentation needed for the certain types of transfers done after the death of a loved one.

Titles that only have the name of the deceased person listed as the owner

- Will of Testament must already be probated and the Probate Court assigned an Executor/Executrix for the estate. That Executor/Executrix will be the person to sign as the seller for all transfers and submit their Executor papers to the clerk’s office.
- If there was not a Will of Testament, the person wanting control of the estate would have to apply for a Petition of Order to Dispense with Administration through their local District Clerk’s Office.
- Kentucky Certificate of Title
- If your title was issued before February 2000, the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) must be completed. Form must be signed by all sellers and buyers and their signatures’ notarized. Titles that contain two names, one of them the deceased person, the other a living spouse that is keeping the vehicle
If the title is titled in two individual names and are not husband/wife, the surviving person must go through Probate Court or obtain a Petition of Order to Dispense with Administration from District Court prior to transferring.

- Death Certificate for the deceased person listing the living person as surviving spouse
- If the surviving spouse is not keeping the vehicle and transferring to another individual, the spouse must put the vehicle in their name first and wait for a Kentucky Title or they can use Executor/Executrix or Adminstrator papers to transfer directly to the other individual.
- Kentucky Certificate of Title
- If your title was issued before February 2000, the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) must be completed. Form must be signed by the living registered owner(s) the signatures’ notarized. Persons that have power of attorney for the living registered owner(s) may sign, but a copy of the power of attorney must be submitted with the application. A power of attorney cannot sign for the seller and buyer if the vehicle is less than ten years old. A power of attorney is not valid for a deceased person. If the County Clerk’s staff notarizes signatures, identification must be presented.

Titles that have two names on the vehicle and both people are deceased

Kentucky Court Order Title Transfer
Transfers that require a court order to process are done through the clerk’s office of the owner/buyer’s county of residence. All court orders must be signed and dated by a judge in order for them to be valid.

- Court Order signed by judge
- Order must have the specific vehicle information listed by VIN #
- Order must have to whom the vehicles is to be transferred to
- It must state in the order that the clerk’s office is to transfer the vehicle
- Owner/Buyer must have Commonwealth of Kentucky proof of insurance to complete transfer. All insurance cards must have the insurance company’s five-digit NAIC number listed on the card. Transfer of Title into a Living Trust
Residents who have recently had a Living Trust filed, may transfer all of their vehicles/boats/trailers into the name of the Living Trust.

- The Certificate of Title (Kentucky, Out-of-State, Certificate of Origin or Manufacturer’s Statement of Origin)
- Copy of the Trust papers
- Copy of the Certificate of Trust papers that show the name of the trust, who the trustee(s) are and the page that says they have the authority to make the transfer into the trust
- Signature page of trust (must have signatures)

Vehicles that are titled as a Trust and the owner(s) are deceased only the person(s) listed as the trustee(s) can sign on behalf of the deceased.

Transfer of Vehicles Purchased from Out-of-State
A person who purchases a vehicle from an individual or dealership is required to title the vehicle(s) within 15 days. If the buyer of the vehicle does not reside in Kentucky, the vehicle shall be registered with the state in which the motor vehicle is principally operated. All Kentucky residents must apply for title and registration through their clerk’s office.

California, Arizona and Washington do not have standard forms; therefore, we require a letter from that state on their Revenue Cabinet’s letterhead stating that the Kentucky resident paid tax to that other state.

Usage Tax-A six percent (6%) motor vehicle usage tax is levied upon the “retail price” of vehicles transferred in Kentucky. “Retail Tax” could be 6% of the current average retail listed in the NADA Used Car Guide, 6% of the sale price or 90% Formula of the Manufacturer’s Suggested Retail Price (MSRP) for new vehicles. A new law passed January 1st, 2007 known as 50% Floor will require the buyer to pay no less than 50% of the trade-in value on any vehicle purchased (excluding vehicles 20 years or older, motorcycles, recreational vehicles and vehicles branded rebuilt). For information regarding 50% Floor, 90% MSRP Formula, exemptions and required forms please see the Usage Tax section.
New Resident Out-of-State Title Transfer
New residents titling vehicle(s) in Kentucky must present the current out-of-state title. If a loan was required to purchase the vehicle, the owner may not have the out-of-state title. Some states send all vehicle titles that required a loan to the lending institution. In those cases, the county clerk’s office will provide the owner with a letter requesting the title from the lending institution. The letter for the lending institution is not downloadable. A county clerk must sign the letter for authenticity. Upon receipt of the letter, the lending institution will forward the out-of-state title to the county clerk’s office for transfer. The county clerk will notify the new resident that the title has arrived. In cases where the out-of-state registration is due to expire, the county clerk’s office will provide the new resident with a one time (30-day) temporary license plate. See the Temporary License Plate section for further information.
NOTE-Please do not wait until your out-of-state registration is close to expiration before coming to the clerk’s office to have your vehicle transferred to Kentucky.

If proof of sales tax paid is not available, presumed credit can be given on vehicles that are being titled in the same name. The owner must show proof of current registration from the other state. The credit is the same percentage charged in the other state and is applied toward the amount owed in Kentucky, which is 6% of the current trade-in value as listed in the NADA (National Auto Dealers Association) Official Used Car Guide.

A person who purchases a vehicle, boat, trailer or recreational vehicle in Kentucky or an out-of-state vehicle that will not be registered, or a motorized vehicle where the buyer has no proof of insurance, will be required to do a Title Only Transfer. Insurance is not required for Title Only Transfers; however, the license plate for motorized vehicles must be surrendered to the county clerk’s office in order to complete the transfer. Only out-of-state license plates do not have to be surrendered to the county clerk’s office. An affidavit is available for circumstances where the license plate is lost or destroyed.
Sales tax is collected on Title Only Transfers for motorized vehicles that will never be used on Kentucky roads. The county clerk’s office will charge a 6 % sales tax based on the sale price located on the Affidavit of NonHighway Use (NHU Form # 72A007). Proof of sale price is required. Please see the Sales Tax section.
Usage tax is collected on Title Only Transfers for motorized vehicles that will be used on Kentucky roads at a later date. The county clerk’s office will charge a 6% usage tax based off the retail price listed in the NADA Used Car Guide or 6% of the sale price. Taxation on 6% of the sale price requires the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) to be completed. If the Kentucky title was issued after February 2000, the sale price information will be completed on the back of the title. Form must be signed by all sellers and buyers and their signatures’ notarized. If the County Clerk’s staff notarizes any signatures, identification must be presented. - License plate(s) for all Kentucky vehicles must be surrendered at the time of transfer. An affidavit is available for license plate(s) that have been lost or destroyed. The Affidavit for Non-Exchange County section of the Affidavit of Replacement Form # TC96-167 must be completed, stating the reason for loss of plate and signed by seller or buyer. Signatures must be notarized.
- Social Security Number for each party appearing on the title or Federal ID Number for companies.
- All liens must be satisfied before applying for a title only. Termination statement Title Lien Statement-Form # TC96-187E must be completed by the financial institution and signed, then submitted to the clerk.
- If a loan was needed for the purchase of the vehicle, the buyer needs to indicate this on the Application for Title/Registration (VTR Vehicle Transaction Record-Form # TC96-182) or the Lien Portion on the back of Kentucky titles that were issued after February 2000. A pending lien will be noted and the buyer will be given a goldenrod copy of the registration to present to the lending institution. If the lending institution is located in another state the county clerk’s office will record the lien. Otherwise, the lending institution will use the goldenrod copy and Title Lien Statement-Form # TC96-187E to record the lien.
- Bullitt County Clerk’s Office accepts Cash, Personal Check, Money Order or Certified Check. The office does accept Visa, MasterCard and Debit. However, to process using a Credit/Debit Card, an additional processing fee is charged. Contact county clerk’s office for details. Credit/Debit Cards cannot be used over the phone.
Property Tax-If at the time of a Kentucky title only transfer, property tax has not been paid, the seller will be responsible for the tax. See Property Tax for further details. If the taxes have not been paid and they are delinquent, the taxes must be paid by the buyer or the seller at the time of transfer.

NOTE-To file a lien the amount is $22.00, however, if the debtor does not file the lien within 20 days of its application, a penalty of $2.00 is assessed by the County Clerk. All liens not filed within 20 days will be $24.00.
